FLSA Overtime Rule Blocked

Fair Labor Standards Act (FLSA) overtime rule blocked by Texas District Court

The U.S. District Court Judge, Judge Amos Mazzant in the Eastern District of Texas granted the nationwide preliminary injunction, saying the Department of Labor’s rule exceeds the authority the agency was delegated by Congress.

As a result of the November 22nd ruling, overtime changes set to take effect Dec. 1 are now unlikely be in play before the Inauguration of Donald Trump, which has disagreed with the Obama administration wage regulation.

This labor law would have increased the minimum salary threshold (from $23,660 to $47,476) for the “white collar” exemption from overtime pay.  The minimum threshold would readjust every three years to keep pace with average wages.
